Remove my articles from your site
I guess if your name is Bruce....this may be considered a real bad bashing!
This bash is not against his site itself...
I sent him this today

Since you have refused to answer any of my previous emails that I have sent to you and since you have banned me all access to Gamefishin.com, I am formally requesting that you immediately remove my 2 articles from your website. The articles that I am referring to are 1) "Float fishing" and 2) "Jigging for Coho".
You prompt attention to my request will resolve any future issue.
If you have any questions regarding my request, please feel free to call me at ******* or by email by cpr-fish@toledotel.com.

If that works for you I might have him remove my recipes... He'll probably go in and alter the site rules to make it say that anything you post becomes site property and you give up right to retract it.

Re: Remove my articles from your site

Re: Remove my articles from your site
Bob,
First things first... print everything off his site immediately and keep copies on hand. This will keep track of any "last minute changes" to his forum rules or defamatory comments. (It happens frequently.) Keep a chronological log of all correspondence. Send registered mail and damn sure keep the receipt. There should be a forwarding address to OK. If "he" claims there was a verbal agreement, "he" has to prove it.
Next send an email to the moderators. Keep that email on file. If you are banned, have someone do it for you now, not later. Make sure your name is in the subject line and/or message context and mention what you are attempting to accomplish- keep copies. Send a "notice" to the newspaper(s) in his local area and ours. Any type of correspondence or method of trying to correspond is good! If there's is still no answer, by default.... You get my drift.
You're work is copyrighted. There's fine lines with copyrighted material, but if you can prove the work is your's, you do not necessarily have to have the copyrighted "symbol" attached to your work. Demand money!
There's a lot of double standards on that site and it only a matter of time and kharma. Just because "he" owns the site and "can do anything he wants" is not always true. There's liability! I have kept/printed a copy of everything and everytime my name crops up! A good example is the recent FishFrontiers.com not returning money to subscribers for videos and the thread being deleted, yet when the slam comes that thread remains "intact" for some time. Go figure! Guess what? I printed it and keep the copies! .... and there's several "printed" examples of this type of material.
Yes, it was me that threatened to sue that site for refusing to remove my articles.... I won't go into details, but... He refused to remove my work, then once it appeared to be removed from the site, there were hidden links to the articles I had to deal with. Wouldn't you know it, my letter was posted by "him" on "his" site with several false accusations and, I was immediately slammed by many that don't even know me. To many, "their" fearless leader appeared to be threatened and slandered by me, yet the truth was hidden "cut and paste" or fictious statements.
It took some work and cost me a few bucks, but well worth it in my opinion.
My point here is document everything... exhaust all methods of contacting him. I have been doing so for almost 5-years. I don't care what "he" says, has or does... I have copies!
It is only a matter of time before his herd catches wind... It is a damn shame... he had a great thing going!

Thanks for the advice. The more I think about it, the more I laugh about it! People will eventually ask him; why would you ban a person from your site, yet keep there published writings and work there? If there writings and works were good enough to be on your site, then why not the person who has wrote and produced them?
Personally, I wouldn't want some ones writings or works on my site if I didn't also want the person who wrote the articles that I am publishing. It makes no sense to ban a person just because a person did not agree with the CCA, but that's exactly why I was banned.
To this day no one in authority on that site has ever responded to my question of why I was banned without any valid reason or notice. Here's an interesting fact; when I was the moderator of the politics of Fishing Forum over there, I brought up the question about changing the "rules" and terms in the middle of the game. One day I had noticed that the sites rules and terms had changed and were completely different then that of the orginal ones that almost everyone had originally agreed to. The vast majority of the members that had originally signed up had agreed to a totally different set terms, policies and conditions.
When I brought this issue up in our private "moderators" forum, I was told that legally, the site had the right to change its policies at any time and with out any notice. Somehow that does not seem to pass the old legal smell test to me. When a person agrees to any "terms" he only agrees to those "terms" that were in effect at the time of his agreement!
Just because a person wants to change those terms and does so with out notifying the other party, IMO it doesn't make it a valid or legal act. In my opinion, it's the site owners responsibility to notify all of its members of any such changes, especially when the change effects the terms that they had originally agreed to. In my case, when I signed up, that site did not have and such conditions or terms that showed that I had agreed to let them have or use my writing and works.
Maybe one of our "legal beagles" such as Todd can actually confirm what the law is concerning the changing of terms and conditions once one has agrees to the original agreement and terms?
What really bothers me more then anything else is that I actually thought that he was my friend. In fact, I had even told him a half dozen times that if he didn't want me to post there that I would not. Instead he couldn't even talk to me and banned me for no reason and to this day refuses to answer any of my emails.
Moral of this story….be careful who you choose as your friends!

You do allow them to change alter and modify the terms of use from time to time in the original terms and conditions however, It would be prudent to give notice of such changes with a sticky thread for a certain period of time as to allow most if not all members the ability to read the changes and chose to participate after full disclosure...

Re: Remove my articles from your site
I wonder if we can get the fishing politics archives back(privately) in some form or another. If whatever I posted is protected under copyright, do we have any recourse to ask for the archived posts? Man there was lots of effort that went into 4 years of posting. All for nothing now.
Welcome "Banned", I don't think you'll have those issues here. There's no comparison between the two owners, completely different motivation.

If you give an author permission to use your copyrighted material in a book he is publishing and then you have your monthly period and get mad at him like a little bitch that author doesn't have to pull all his books worldwide. :95:
